Background Briefing (5am)

Background Briefing (5am) – February 7, 2024

If Trump is Disqualified From the Ballot, Waves of Violence Will Follow Whether He Wins or Loses the Election

We begin with the blunt ruling from a three-judge panel on the Court of Appeals denying Trump absolute immunity, which he is bound to appeal as he seeks to delay the insurrection trial. Joining us to discuss that and Thursday’s Supreme Court hearing on Colorado’s attempt to disqualify Trump from the ballot and whether that would trigger serial overlapping waves of resistance is Aziz Huq, a Professor of Law at the University of Chicago. He is a former clerk for Supreme Court Justice Ruth Bader Ginsburg and is the co-author of Unchecked and Unbalanced: Presidential Power in a Time of Terror and How to Save a Constitutional Democracy, and his latest book is The Collapse of Constitutional Remedies. He’s a contributor to an article at Politico which we discuss, “Supreme Court Shocker? Here’s What Happens if Trump Gets Kicked Off the Ballot.”

The Right Wing “Texit” Movement Russia and China Are Encouraging

Then we look further into the season of violence ahead starting with today’s request by Nikki Haley for Secret Service protection from Trump’s supporters fired up with vengeance because of his denunciations of her. Joining us to discuss how violence is moving from the back-burner to the front-burner as the 2024 election gets underway is Wendy Via, the President and Co-Founder of the Global Project Against Hate and Extremism where her work focuses on the effects of extremism on our society, systemic racism, economic inequality, immigration, criminal justice reform, and LGBTQ rights. Previously, she was the Chief Communications and Development Officer at the Southern Poverty Law Center and helped launch Justice for Migrant Women.
